Terms of Service

1. Acceptance of Terms

By accessing or using Plortal ("the Platform"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our services.

You must be at least 18 years old to use Plortal. By using the Platform, you represent and warrant that you have the legal capacity to enter into these Terms.

2. User Accounts

2.1 Account Creation

You must create an account to use certain features of the Platform. You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate.

2.2 Account Security

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must immediately notify us of any unauthorized use.

3. For Content Creators

3.1 Content Submission

• You retain ownership of all content you submit
• You grant Plortal a license to display and track your submitted URLs
• You warrant that all submitted content is your original work or you have rights to submit it
• You must accurately submit URLs without manipulation or fraud

3.2 Creator Payments

• Earnings are calculated based on verified view counts at the campaign's CPM rate
• Platform fee: 2% of earnings, deducted at payout
• Minimum payout amount: $10 USD
• Payouts processed weekly via PayPal
• You are responsible for all applicable taxes on your earnings

3.3 Prohibited Activities

• Using bots, automation, or artificial means to inflate view counts
• Submitting content that violates third-party rights
• Creating multiple accounts to circumvent platform rules
• Submitting the same content multiple times to the same campaign

4. For Businesses

4.1 Campaign Creation

• Campaigns must contain accurate information and legitimate business purposes
• You may not create campaigns for illegal, harmful, or deceptive purposes
• Minimum campaign budget: $50 USD
• You set your own CPM (cost per thousand views) rate

4.2 Business Payments

• Campaign funding processed through Stripe
• Platform fee: 20% of campaign budget
• Funds are non-refundable once campaign is activated
• Unused budget at campaign end may be applied to future campaigns

5. Platform Rules

5.1 Prohibited Content

• Illegal content or activities
• Hate speech, harassment, or discriminatory content
• Adult or sexually explicit content
• Violence or graphic content
• Misinformation or deceptive content
• Spam or misleading metadata

5.2 Platform Conduct

• Users must interact respectfully with others
• No manipulation of metrics or fraudulent activity
• Comply with all applicable laws and regulations
• Respect intellectual property rights

6. Payment Processing

We use third-party payment processors (Stripe for incoming payments, PayPal for outgoing payments). By using our payment features, you agree to be bound by their terms of service and privacy policies.

All fees are clearly disclosed before any transaction. Platform fees are automatically deducted and are non-refundable.

7. Intellectual Property

The Plortal name, logo, and all related marks are trademarks of Plortal. You may not use our intellectual property without express written permission.

Users retain ownership of their content but grant Plortal necessary licenses to operate the platform, including displaying campaign information and tracking submitted URLs.

8. Disclaimers

THE PLATFORM IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. WE DO NOT GUARANTEE:

• Any specific level of earnings for creators
• Any specific results for business campaigns
• Continuous or uninterrupted service availability
• Accuracy of third-party platform metrics

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PLORTAL SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF YOUR USE OF THE PLATFORM.

Our total liability shall not exceed the amount of fees paid by you to Plortal in the six months preceding the claim.

10. Indemnification

You agree to indemnify and hold harmless Plortal and its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of the Platform or violation of these Terms.

11. Termination

We reserve the right to suspend or terminate your account at any time for violation of these Terms or for any other reason at our sole discretion. You may delete your account at any time through your account settings.

12. Modifications to Terms

We may modify these Terms at any time. We will notify users of material changes via email or platform notification. Continued use of the Platform after changes constitutes acceptance of the modified Terms.

13. Governing Law

These Terms shall be governed by the laws of the United States and the State of Delaware, without regard to conflict of law principles.
